The client agrees to indemnify and hold harmless SharkHosting from any claims resulting from the use of service which damages the client or any other party.

Prohibited are sites that promote any illegal activity or present content that may be damaging to SharkHosting's servers, or any other server on the internet. Links to such materials are also prohibited.

SharkHosting is a web hosting company. We offer web hosting services and support. Additional support in relation to HTML/PHP coding, script, website installation, setup or modifications are provided as an additional free service at the discretion of SharkHosting. Full details of the issue you are facing and how it may have occurred must be provided. We are not a web development company.

Account Activation


By activating your account with SharkHosting, you agree to the terms of service within. Upon requesting activation of an account, you are required to accept these terms of service, and a copy of your acceptance is forwarded along with your activation request to be maintained with your account information.

NOTICE: If you sign up for an account and fail to comply with these terms, your account can be suspended without warning. No refunds will be given.

From time-to-time SharkHosting may select accounts at random to perform security and confirmation checks. This will involve you providing two proofs of identity before allowing you to continue using our services. We would require proof of your full name and address within 7 days of your account being setup. This can include, but is not limited to; passport, driving licence, birth certificate, department of defence or military ID, national ID card and utility bill with full address. These details must match with your payment method and our team will carry out checks within 48 hours of receiving your documents. Failure to provide such proof within 7 days will result in account suspension and services terminated. All documentation received is securely destroyed once our checks have been completed. False documentation will be reported to the authorities.

Firstly, adult websites are allowed to be hosted with us as long as they abide by our terms of service within. If a report is received we will have to act upon it which may involve account suspension until resolved.

Adult websites must also be hosted with the appropriate hosting package. Failure to do so could result in account suspension. These packages have been specifically designed for such websites.

- Viruses, trojan horses, mass ping, ddos, udp or tcp flood scripts, or other kind of desctructive scripts

We do not allow domains/subdomains with 'paypal' or any other services names, for example 'sony', 'google' and etc.

NOTICE FOR REPEAT OFFENDERS: IF YOUR ACCOUNT IS FOUND TO CONTAIN ILLEGAL ACTIVITY, ILLEGAL MP3 FILES, PIRATED SOFTWARE, HACKER PROGRAMS, WAREZ PROGRAMS, OR ANY OTHER ILLEGAL FILES, YOUR ACCOUNT WILL BE TERMINATED IMMEDIATELY, WITHOUT NOTICE, AND A FINE OF £1,000 WILL APPLY PAYABLE WITHIN 14 DAYS. SHARKHOSTING RESERVES THE RIGHT TO UNDERTAKE COURT ACTION TO RECOVER THE FINE IMPOSED. ADDITIONALLY, SHARKHOSTING WILL NOTIFY THE PROPER AUTHORITIES OF YOUR ACTIONS.

SharkHosting also operate a 3 strikes-out rule whereby if these terms are broken twice, on the third occasion SharkHosting reserves the right to issue a lifetime ban. This can be without notice or warning and will prevent you from using SharkHosting's services again. No refunds will be processed.

Traffic Usage

All account plans come with a predetermined amount of traffic allowance. We monitor all accounts and suspend accounts if limits are exceeded.

Server Abuse

Any attempt to undermine or cause harm to a server or client of SharkHosting is strictly prohibited. As our client you are responsible for all your accounts. Should you violate the Terms of Services outlined within, your account will be cancelled/suspended without refund.

Refusal of Service

We reserve the right to refuse, cancel or suspend service, at our sole discretion.

All sub-networks, distributive hosting sites of SharkHosting must adhere to these terms.

Billing

By the Account Activation Date of each month, SharkHosting shall either:

(1) debit the client's credit/debit card or PayPal account (when such information has been provided by the client); or

(2) deliver, by e-mail, an invoice in accordance with the applicable service fees for services rendered for the current month. When an invoice is delivered to the client, payment shall be remitted to SharkHosting by no later than the specified payment due date. SharkHosting shall be entitled to immediately terminate this agreement for a client's failure to make timely payments. You will be provided with an invoice on a monthly basis. All credit/debit cards and PayPal accounts are billed automatically on a monthly basis. It is the client's responsibility to ensure that they have sufficient credit to cover this transaction. In the event that there is insufficient credit, we will send an e-mail notification, at which point we will need to be provided with an alternative method of payment either credit/debit card or PayPal account.

If the outstanding invoice remains unpaid for a total of 7 days, after the payment due date, then a late payment fee of 10% of the outstanding invoice will be applied. Your account will automatically be suspended beyond our control. Your service will resume automatically upon payment of the outstanding invoice including any late payment fee applied.

If your account remains overdue and unpaid for a total of 45 days after your payment due date, then your account will be terminated immediately. This will result in a total loss of your website files, MySQL databases and email accounts. These will all be unretrievable and SharkHosting cannot be made liable for such instances. You are asked to agree to these terms at point of sale in order for an account to be created. It is your responsibility to ensure your account does not go overdue.

Payment Disputes & Chargebacks

If there is a problem, or you would like a refund, please talk to us and let us know. Payments can sometimes be disputed through your bank, credit card company, or PayPal. When this happens, the transaction is reported as unauthorized or fraudulent, and we are fined £20.00 by our payment processor for each occurrence. Whilst the charge is in dispute, your account will be suspended.

You will need to cancel the dispute on the payment through your bank, credit card or PayPal so that we have the option to refund the charge. While the dispute is active we do not have the option to issue a refund. If you prefer not to cancel the dispute or it is too late, you will be refunded once the payment provider has completed the dispute resolution, which can take up to 75 days.

If you would like to continue using your site:

1. If the dispute was done recently, you might be able to cancel the dispute with your bank or PayPal. Once you’ve canceled the dispute, please let us know, and we’ll assist you in restoring your site.

2. If you prefer not to cancel the dispute or it is too late, you will be refunded once the payment provider has completed the dispute resolution, which can take up to 75 days. In this case, a £20.00 fee must be paid if you’d like to restore your web hosting account.

Service Fees

Certain services carry a setup fee charged by SharkHosting to the client, which must be paid by the client in order to have use of said services. If the client terminates this agreement, the client shall be responsible for any and all outstanding fees owed to SharkHosting and agrees to pay any and all fees incurred by the client. Because the services are provided on a monthly basis, the client will be responsible for service fees incurred each month, regardless of when the client provides notice of termination. Thus, for example, if the client provides notice of termination on the 15th day of a particular month, the client will be responsible for service fees for the entire month, and such fees will not be pro-rated or refunded.

30 Day FREE Trial

SharkHosting offer all clients the chance to try our services totally risk free for 30 days. Once 30 days have passed, normal billing will resume unless you have submitted a cancellation request on the 28th day of your 30 day free trial.

Applies to the Blue, Tiger & Whale Shark packages on a monthly subscription only. Option to upgrade/downgrade and/or change your billing cycle once your trial period ends.

Money Back Guarantee & Refund Policy

If a request is submitted for an immediate cancellation within the first 30 days, a full refund will be issued. Applies to all web hosting packages excluding domain names.

Refunds on a prepaid account after 30 days: If the client has pre-paid SharkHosting for web hosting services, refunds will be issued for any unused full month of such services, upon the client's request. Therefore, if the client's account is cancelled at any point during the one, two or three year term, the client will be entitled to a refund for the months remaining, after notice given by the 28th day of the current month. Notice given after the 28th day will count as the following month. Excludes; Unlimited 1, Unlimited 2, Unlimited 3, Cloud 1, Cloud 2 & Cloud 3 packages.

We DO NOT refund partial monthly fees to accounts. Domain registrations, domain addons, setup fees and migration fees are not refundable.

For FREE domain registrations the retail price of the domain will be deducted from the refund amount upon cancellation if applicable. Alternatively, if the refund amount is less than the retail price of the domain, you will be invoiced for the difference. Once the invoice has been settled, only then will you retain ownership of the domain.

Cancellation Requests

Any immediate cancellation notification requests from within the client area are treated as such and will be processed within 24 hours. We strongly suggest that all vital website information is backed up and removed before requesting a cancellation. Once cancelled the account will be terminated and all information within that account will be securely destroyed including any automated backups.

Any end of billing cancellation notification requests from within the client area are treated as such and will be processed at the end of the current billing period for the client's applicable web hosting service. We strongly suggest that all vital website information is backed up and removed before the end of the billing period. Once cancelled the account will be terminated and all information within that account will be securely destroyed including any automated backups.

It is your responsibility to cancel any active subscription that may be in place with your payment method, such as PayPal, to avoid any further automated payments where applicable.

Account Deactivations

Unsolicited commercial advertisements ('SPAM') are not allowed in e-mail, and will likely result in account cancelation. SharkHosting takes a zero-tolerance approach to SPAM originating from its servers or for spam advertising of domains hosted within our network. If found, YOUR account may be deleted.

Any account deactivated due to non-payment will require the full outstanding balance to be paid plus any late payment fees before reactivation can take place. This is an automated process of which we have no control over.

Any attempt to setup a new active account will result in a total ban from our hosting services. You will be unable to obtain any services from us or our partners and will forfeit the right to retrieve your data from your web hosting account. All requests will be ignored as you will no longer be a client of SharkHosting.

Account deactivation can also occur as a result of 'time wasting activities'. For example; submitting multiple support requests, either via email, support ticket or live chat regarding the same issue despite it being resolved or responded to previously multiple times. Whilst every effort is made to ensure that the contact details we have, or the email addresses provided to us are correct, and that we have gained as much information as possible from you to resolve the issue quickly and effectively, it is ultimately the user who inputs and advises us of this information that is responsible for the accuracy of this information.

Refusal of Service

We reserve the right to refuse, cancel or suspend service, at our sole discretion.

Limitation of Liability

SharkHosting shall not be responsible for any claimed damages, including incidental and consequential damages, including loss of earnings or sales revenues, which may arise from SharkHosting servers going offline or being unavailable for any reason whatsoever. Furthermore, SharkHosting shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any website from one of SharkHosting servers. All damages shall be limited to the immediate termination of service.

Violations

Violations of these Acceptable Use Policies should be referred to us by emailing: contactus@sharkhosting.co.uk. All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation.

DMCA

SharkHosting is an online service provider. We provide legal copyright owners with the ability to self-publish on the internet by uploading, storing and displaying various media utilising our services. We do not monitor, screen or otherwise review the media which is uploaded to our servers by users of the service. We take copyright violation very seriously and will vigorously protect the rights of legal copyright owners. If you are the copyright owner of content which appears on a website hosted by us and you did not authorise the use of the content you must tell us in order for us to identify the alleged infringment and take action.

Violations should be referred to us by emailing: dmca@sharkhosting.co.uk. You must provide the following when emailing us:

All notices are investigated promptly. Even if you believe you didn't steal it, you must remove it. Until you can confirm ownership and get the situation settled, removing the content in question will protect you from any further action from either the person claiming to own the content, or from your Internet Service Provider (ISP). Failure to do so may result in immediate account deactivation.

Disclaimer

SharkHosting cannot be held liable for system down time, crashes or data loss. We cannot be held liable for any predicated estimate of profits which a client would have gained if their website was functioning. Certain services provided by SharkHosting are resold. Thus, certain equipment, routing, software and programming used by SharkHosting are not directly owned or written by SharkHosting. Moreover, SharkHosting holds no responsibility for the use of our client's accounts. Failure to comply with any terms or conditions will result in the automatic deactivation of the account in question. We reserve the right to remove any account, without advance notice for any reason without restitution, as SharkHosting sees fit.

We always advise that it is the client's responsibility to maintain their own account backups. SharkHosting's backup services are provided as an additional free service and cannot be relied upon.

FREE Website Migration

We offer a FREE website migration service to move your website from your current web host to us. This can be done within 24-48 hours, but we will always aim to have it transferred within 24 hours or less upon receipt of a support ticket from you requesting this transfer. Your website must be under 2GB including any databases & email accounts that come with it. If it is over 2GB in total, we would suggest reducing its size to below 2GB to be eligible for the FREE migration service. Anything over 2GB is charged at £1 for each additional 1GB of data. This is non-refundable.

We cannot guarantee the following; to transfer every file and for your website to be working and operational, that every email account and its contents is transferred in full & to transfer your site within 24 hours. However, we will do our best to assist you in getting your website back to the same standard it was with your previous host.

UNLIMITED Usage Policy

SharkHosting offers some of its hosting packages with “Unlimited” amount of resources for specific options (disk drive space, bandwidth, domains per account, and others). This means that SharkHosting will not set a specific cap for these resources and the client will be able to use these resources as needed, however fair usage applies to all accounts. If a client uses the resources of the shared server to the extent where he is negatively affecting other users hosted on the same server, the client may be suspended with or without warning and advised to upgrade their account to a package more suitable for their needs or fixes the issues so the resource usage on their account stops and no longer negatively affects other users on the same shared server.

By the term “Unlimited Space” SharkHosting means that it will not set a cap on the amount of files the user may host on his account, however the space on the hosting account cannot be used for: Backup storage, Online storage, File sharing services, Movie storage, Photo storage, Software storage, Copyrighted content storage, Illegal, Abusive or Offending file storage, Document Archives or any other type of Archive, File Backups (with the exception of a single cPanel backup generated from your cPanel), log files, etc. SharkHosting reserves the right to remove such files from the user account with or without notice to the client. SharkHosting also reserves the right to remove any single files larger than 1GB from the user account regardless of the content of the file with or without notice to the client. SharkHosting also reserves the right to clean up a user account by removing files which fall under the criteria of files that may not be hosted on SharkHosting accounts, if there are more than 250,000 files on a single account, with or without notice to the client. SharkHosting also reserves the right to disable the account which holds more than 250,000 files until the relevant shared hosting account is upgraded by the client to a service where such limitation is not applied.

We have an automated weekly backup system in place which backs up all user accounts no larger than 2GB in total size every 7 days. SharkHosting cannot guarantee that these backups will be available at anytime. Accounts over 2GB in total size will not be backed up via our automated backup system. However, users are able to utilise the cPanel Backup facility in their cPanel accounts for manual backups.

Server Uptime Guarantee

SharkHosting guarantees 99.9% service (http, ftp, pop, imap, smtp) uptime on all hosting plans. This is calculated over the course of a 12 month period. Should we fail to deliver this, your account will be credited once for the amount of your normal monthly package price.

The availability of a website is measured by a percentage usually over a 12 month period in which the website is publicly accessible and reachable via the internet. This is different from measuring the uptime of a system. Uptime refers to the system itself being online. Uptime does not take into account being able to reach it as in the event of a network outage.

How downtime is determined changes from provider to provider. SharkHosting will guarantee at least 99.9% uptime which will allow for 43m of downtime per month, or 8h 45m of downtime per year. This allows us to perform maintenance on systems and servers when required.

SharkHosting reserves the right to amend any or all of these terms without notification. We also retain the right to increase any pricing and make changes to our account plans without notification.
